MARKETING YOUR GENERAL PRACTICE FIRM ONLINE

It used to be that all a local law firm had to do to get noticed and drive potential clients to their door was to advertise in the local newspaper or Yellow Pages directory. Year after year, the firm would place what was often a costly print ad around the same time and typically in the same publications. To change things up, they might consider adding new graphics, moving the location, or increasing the ad size if they had the money. They would then wait for new clients to call or come knocking on their door—assuming, of course, the ad was actually viewed or found by potential clients in the first place.

NSBA CHARITABLE FUNDS, INC. AWARDS LSAT PREP SCHOLARSHIPS

NSBA Charitable Funds Inc announced the recipients of the 2008 LSAT Prep Scholarship Program. The scholarship program was established by the Nebraska Minority Justice Committee to expand the pipeline of diverse law school applicants. As Linda Crump, Co-Chair of the Nebraska Minority Justice Committee explains, “LSAT exam scores are one of the primary factors considered by law schools in the admissions process. Given the high stakes, it is not surprising that many enroll for a LSAT preparatory exam. There is, however, a considerable expense in enrolling for this class.

This scholarship is meant to help minority students overcome the economic barrier they may face in taking the LSAT Prep Course.” The program provides a scholarship for a Kaplan LSAT Prep Course and covers the costs of registering for the LSAT exam. The four scholarship recipients are: Elizabeth Baxter, Elisabeth Dority, Jannette Taylor and Stacy Marie Henry.

The Scholarship Program was funded by the generous financial contributions of: Koley Jessen PC LLO (Platinum Level Sponsor); Baird Holm LLP, Berens & Tate PC LLO, and Husch Blackwell Sanders (Gold Level Sponsors); and Legal Aid of Nebraska and McGrath North Mullin & Kratz PC (Silver Level Sponsors).

Neb. Ct. R. of Dist. Cts. 21 and Appendix 3
On April 16, 2008, the Nebraska Supreme Court adopted Neb. Ct. R. of
Dist. Cts. 21, PROTECTION OF PERSONAL AND FINANCIAL INFORMATION IN
CIVIL COURT RECORDS, and Appendix 3, a form on which to include
personal and financial information. The privacy rules shall apply to
all pleadings, documents, exhibits, court orders, judgments, and
decrees filed in all civil actions in the district courts of
Nebraska.

On April 16, 2008, the Nebraska Supreme Court adopted Neb. Ct. R. of

jurisdiction of the county court, Neb. Ct. R. of Dist. Cts. 21 shall

LB 1014, Changes to Nebraska's Parenting Act

LB 1014, signed by the governor on April 16, 2008, makes further changes to Nebraska’s Parenting Act, as well as addressing other matters. This LB is lengthy but is worth reviewing to see what has changed in a number of areas of law. Different sections of the law take effect at different times. Those sections with an emergency clause take effect immediately. Other sections will take effect July 17 or as specified in the bill itself.

RISK MANAGEMENT TIP FROM MARSH: DOCUMENT RETENTION

A REMINDER OF WHAT THE ABA RULES ARE FOR DOCUMENT RETENTION:

Model Rule 1.16 (d) states:
“Upon termination of representation, a lawyer shall take steps to the extent reasonably practicable …The lawyer may retain papers relating to the client to the extent permitted by law.”

Model Rule 1.15 (a) states:
Complete records of client funds and other property, which includes client files, must be held for five years after the representation.

REMEMBER: THE COVERAGE TRIGGER IN YOUR PROFESSIONAL LIABILITY POLICY IS CENTERED ON THE FAILURE OR ALLEGED FAILURE TO PROVIDE ADEQUATE PROFESSIONAL SERVICES. IF PRACTICABLE, YOU SHOULD RETAIN ENOUGH INFORMATION IN YOUR FILES TO BE ABLE TO PROVIDE AN ADEQUATE DEFENSE IF AN ISSUE SHOULD ARISE.
