Instruction Booklet for Individuals Who Take Their Own Case to the Nebraska Supreme Court or Nebraska Court of Appeals

Nebraskans who choose to represent themselves before the Nebraska Supreme Court or Nebraska Court of Appeals can now better prepare themselves thanks to a newly completed booklet by the Nebraska Supreme Court Committee on Pro Se Litigation.

The booklet, titled “Citizen’s Guide to the Nebraska Appellate Courts,”
summarizes the process and function of the appeals courts of Nebraska with a step-by-step outline designed to be understood by a non-lawyer. It is available through the Supreme Court Clerk’s Office and on the Nebraska Judicial Branch Web site: http://court.nol.org/public/self_help/index.htm

TEN SUBMIT THEIR NAMES FOR DISTRICT COURT JUDGE IN THE EIGHTH JUDICIAL DISTRICT

LINCOLN -- Michael S. Borders, William J. Erickson, Cheryl C. Guggenmos, James J. Orr, Tami K. Schendt, all of Broken Bow; Gregory G. Jensen and Curtis A. Sikyta, Ord; Dale C. Crandall, Burwell; Wesley D. Nespor, Fullerton; and Karin L. Noakes, Grand Island, have submitted applications for appointment as District Judge in the 8th Judicial District consisting Blaine, Boyd, Brown, Cherry, Custer, Garfield, Greeley, Holt, Howard, Keya Paha, Loup, Rock, Sherman, Valley, and Wheeler counties. Broken Bow, Ord, or St. Paul may be chosen as the principle office by the judge-designate.
The vacancy is due to the retirement of Judge Ronald D. Olberding effective April 30, 2006.


The public hearing of the Judicial Nominating Commission will be held at the Howard County Courthouse, 612 Indian Street, in St. Paul, Nebraska, beginning at 10:30 a.m. on Wednesday May 17, 2006. The Commission will review all applicants for the office at that time. The public is welcome to attend the hearing and present information concerning candidates for the judicial opening.

A DISCUSSION ON IMMIGRATION, DISCRIMINATION, AND OPPORTUNITIES FOR MINORITIES IN THE LEGAL PROFESSION

On May 15, 2006 at the Hruska Law Center (635 S. 14th Street, Lincoln NE) Department of Justice Counsel Alex MacLean will be leading the following sessions:

9:00 a.m.-10:00 a.m.- An Overview of the Office of Special Counsel for Immigration Related Unfair Employment Practices-Civil Rights Division

10:15 a.m.-11:15 a.m.- Discrimination Based on National Origin and Citizenship

11:30 a.m.-12:30 p.m.- Minority Access to Legal Professions: Going from Nebraska to Washington D.C.

MacLean serves as Counsel in the Office of Special Counsel for Immigration-Related Unfair Employment Practices in the Civil Rights Division of the Department of Justice. MacLean is responsible for coordination and advising all aspects of the Special Counsel's policy matters; serving as an Inter-Governmental liaison with other agencies, tracking immigration related legislation; and providing outreach to employers, employees and non profit organizations. MacLean earned a Bachelor of Arts from Arkansas State University and Juris Doctorate from the University of Nebraska. MacLean is a member of the New York Bar.

ADR SEMINAR

So what is ADR?

“Usually it starts with all the parties and their attorneys meeting in a room together with the mediator. The mediator makes introductions and gives either a long, a longer, or a short introduction. Then each side gets to make a statement. At this point, the mediator breaks the group up and each side goes to a room of their own. The mediator shuttles between the rooms, helping the parties exchange offers. A good mediator also helps the parties examine their interests, reframe the issues and plays the devil's advocate. A mediator may or may not also help the parties in evaluating the matter.

At the end, usually about 85% of the time with a good mediator, the parties reach an agreement that is in their best interests. If they decide to sign off on a signed agreement, the signed agreement is binding. Also, some federal courts have made oral agreements binding and the 5th Circuit Court of Appeals has enforced oral agreements even when the parties disagreed about what they had agreed to. On the other hand, some states have laws that if it isn't a signed agreement filed with the trial court, it doesn't count.

For those of you who are not familiar with Alternative Dispute Resolution and its increasing importance in the practice of law in many practice areas, you will want to consider attending ADR: Principles and Practices for Attorney Advocates May 19 at the Doubletree Hotel.

This program will discuss the several models of mediation currently in us, devoting much of the morning to the discussion of the evaluative mediation model often used in employment and personal injury cases. Jay Welch, Alan Frank, Debora Brownyard, and others will help make this demonstration interesting and informative. These lawyers and Robert Kirby, Denise Saathoff, Lisa Line, and others will follow the demonstration with a panel discussion of the different areas of civil litigation where ADR is playing an increasing role.

The afternoon sessions will be devoted to an exploration of ethics (is it malpractice not to advise your client of the possibility of the ADR options?) and a demonstration of interest-based mediation in the resolution of an estate dispute.
