APPELLATE BRIEF BANK
The Nebraska State Bar Association is expanding the Casemaker™
Library. We have added an appellate brief bank where an active
member of the NSBA will be able to do a word search and locate
briefs written by other Nebraska lawyers on the issues set
forth in the search.
Please send the NSBA a copy of your brief in electronic format.
Only briefs received electronically will be added to Casemaker™.
The file needs to be in a Word or Word Perfect format and
the file name must be unique, otherwise a later file with
the same name will overwrite it. Please include a specific
case name for each brief. Your participation in the brief
bank project is voluntary.
Please send your brief to Sam Clinch at sclinch@nebar.com
or mail the brief on disk or CD-Rom to:

P.O. Box 81809
Lincoln, NE 68501-1809

PRACTICE TIP: THE TWO MINUTE RULE
If you pick up a file, document, letter, or phone message,
and can get it done in two minutes or less, do it immediately!
If it will take longer than two minutes, quickly assign it
a high, medium or low priority, then add it to your "to
do" list. Now get it off your desk and out of your mind
until it comes up on your "to do" list again. Try
this for several days, and see if it helps you get your work
done!

PRACTICE TIP: CONFIDENTIALITY
Practice management advisors from bar associations and
law societies (in Canada) make numerous visits to law practices
to help lawyers in the management of their practices. One
issue that frequently arises is the confidentiality of client
information. If you are in an office sharing arrangement,
you should take overt steps to ensure that persons not associated
with your practice do not have access to your files or other
client information. Client files must remain confidential,
and that confidentiality does not extend to other lawyers
or non-lawyers sharing your suite. Lock your office door when
you're out of the office. Remember to do the same with the
files on your secretary's workstation or in file cabinets
in a public area. Also, if you share a receptionist, be sure
to periodically remind him or her not to discuss your business
or your clients with others sharing the suite.

PROFESSIONAL LIABILITY-ARE YOU READY?
Try to recreate an insurance history at least five years.
Ten years is more beneficial. Keep Declaration Pages, endorsements,
applications and complaints to the Bar.
Ask your carrier for a loss run every year. Keep these in
a historical file to track the development of claims over
a period of time.
A complete claim history is important. Reporting potential
matters and claims to your carrier in a timely manner not
only protects your coverage rights, it provides the carrier
with information needed to help you manage the situation.
Provide information on your docket/time management system
and your client communication systems. Even if you have provided
this information on past applications, let the carrier know
what improvements you have made. For an underwriter, knowing
a firm's internal procedures can make a definite impact on
how the overall risk is viewed.
