Title: Judicial Law Clerk
Department: Nebraska State Library
Location: State Library, State Capitol, Lincoln, NE
Salary Range: $3,309/month
Hours: Full -Time, 12 - 24 month term
8:00 a.m. - 5:00 p.m.
Start Date: January 2005

QUALIFICATIONS:
Admitted to practice law in Nebraska. Experience using electronic
resources such as Westlaw, Lexis-Nexis, Shepards, Keycite, and the
Internet. Experience in operating a personal computer, using email and
familiarity with Word XP.

BASIC SKILLS AND ABILITIES REQUIRED:
Excellent research and writing skills, time-management skills, and
ability
to understand and manage complex factual and legal issues. Ability to
utilize word processing skills to prepare work product. Ability to work
cooperatively with judges, court administrator, court personnel,
attorneys
and other governmental offices and agencies.

DUTIES AND RESPONSIBILITIES:
Under the direction of the State Court Administrator, the Law Clerk
performs legal research, as directed, for the district judges of the
State
of Nebraska, as well as for the State Court Administrator. The Law
Clerk
prepares written legal memoranda, drafts, edits, and proofreads legal
correspondence, and performs related assigned duties under direction of
the
district court judges. The Law Clerk works directly with selected
district

MINORITY AND JUSTICE IMPLEMENTATION COMMITTEE RELEASES UPDATE ON NEBRASKA'S INDIGENT DEFENSE SYSTEMS

Nebraska’s Minority and Justice Implementation Committee has recently completed and approved a report entitled, “The Indigent Defense System in Nebraska: An Update.” This report is an assessment of the progress Nebraska has made since the Spangenberg Group’s original 1993 study of “Indigent Defense Systems in Nebraska”.
The analysis begins with a report card for Nebraska which assesses Nebraska’s compliance with the “ABA Ten Principles of A Public Defense Delivery System.” Second, we update information about county indigent defense costs and cases by reporting the most recent data available and comparing it to the information reported in the 1993 study conducted by the Spangenberg Group, “The Indigent Defense System in Nebraska.” Third, the findings and recommendations from the 1993 report are revisited, noting which findings appear to still apply and which recommendations have been implemented. Finally, the Spangenberg Group, national experts on the issue of indigent defense and the authors of the original 1993 study, offer their assessment of Nebraska’s progress. YOUNG LAWYERS BEST PRACTICES SEMINAR SERIES

You are invited by the Nebraska State Bar Association's Mentoring Committee and Young Lawyers Section to attend, free of charge, the Best Practices seminar series. The eight session series will focus on a wide range of substantive topics and will offer practical training for new lawyers and identify available resources to aid in your practice. The sessions will be led by experienced Nebraska attorneys who will offer insight, from a practical prospective, on how to successfully practice law. Additionally, at the conclusion of each seminar, the Nebraska State Bar Association will sponsor a free Reception for the participants to get to know each other and other members of the Nebraska Bar. Here is your opportunity to obtain high quality training at no cost and meet many fellow Bar Members.

JUDGE BEAVERS ATTENDS PHASE I OF THE INSTITUTE FOR FACULTY EXCELLENCE IN JUDICIAL EDUCATION

Judge Graten Beavers of the Buffalo County Court attended Phase I of the Institute for Faculty Excellence in Judicial Education held at Bolivar, Pennsylvania, from October 10-15, 2004.

The Institute, directed by Dr. Patricia H. Murrell of the Center for the Study of Higher Education at The University of Memphis, brings together a select number of trial and appellate judges each year, teaching them to become better judicial educators and to improve the quality of their court’s functioning through the application of principles of adult learning.

Judge Beavers’ attendance at this conference was made possible by a scholarship from the State Justice Institute. The State Justice Institute (SJI) is a non-profit organization established by Federal law to award grants to improve the quality of justice in State courts nationwide, facilitate better coordination between State and Federal courts, and foster innovative, efficient solutions to common problems faced by all courts. November 24, 2004, Application Deadline Set for County Court Judge Vacancy,
12th Judicial District

LINCOLN -- According to Supreme Court Justice Michael McCormack, the Judicial Nominating Commission for County Judge in the 12th Judicial District (consisting of Banner, Box Butte, Cheyenne, Dawes, Deuel, Garden, Grant, Kimball, Morrill, Scotts Bluff, Sheridan and Sioux Counties) will hold a public hearing at the Old Courthouse Building, 1725 10th Street, 1st Floor, County Courtroom # 2, in Gering, Nebraska, beginning at 12:00 p.m.
on Thursday, December 16, 2004. The primary office for the judicial vacancy is Scottsbluff. At the hearing, the Commission will receive information on the qualifications of candidates to fill the vacancy in the office of County Judge due to the retirement of Judge James L. Macken effective December 31, 2004.

The public is welcome to attend the hearing and present information concerning candidates for the judicial opening. Individuals interested in applying for the position must do so on an approved form available through the Chairperson of the Commission or the Office of the State Court Administrator, P.O. Box 98910, Lincoln, NE 68509. The application form may also be printed from the Nebraska Judicial Branch Web site at http://www.nebraskacourt.com/manual/application.htm. PRACTICE TIP: TAKE CARE OF YOURSELF

1. Exercise: Exercise is one of the most effective anti-stress, and anti-depression tools in behavioral medicine. Try to build reasonable steps to a new lifestyle of increased exercise. Do what you enjoy most: Aerobics, short walk, take the stairs, sports etc.

2. Try relaxation exercises: Take a five-minute break each afternoon and practice "Imagery"--a popular relaxation technique. Imagery is sitting back and remembering a favorite event such as a vacation or a round of golf. Try to use all of your senses (the sound of the surf, the smell of the salt air, the feel of the sun on your skin, the colors of the setting sun) and take poetic license (a golf game can be your favorite 18 holes played all together)

3. Practice good nutrition (and not because your mother said so) Improved nutrition is a very important aspect of behavioral medicine. Lighter meals and less excess weight yield increased energy. Increasing fruits and vegetables (even by one serving per day) is effective. Research has shown that small achievable steps toward a lifestyle change are more enduring and thus more effective than large changes.

PRACTICE TIP: A TRAINING LUNCH

As the immortal Yogi Berra said, "you got to be careful if you don't know where you're going, because you might not get there." Two things should never stop in your law firm-training and marketing. You need a year-round, career-long commitment to both marketing and training. Docket training and marketing goals are just like court deadlines. Set goals for a set number of luncheons each month with possible sources of new business. Every three months have a "training lunch" where one staff member teaches a few new tricks to the rest of you. Let someone develop macros or other document automation and then show the rest of you.
