MINORITY AND JUSTICE IMPLEMENTATION COMMITTEE 2004 PROGRESS REPORT

The Nebraska Supreme Court and the Nebraska State Bar Association, with the assistance of the Public Policy Center, established the Minority and Justice Task Force in 2001 to identify actual or perceived racial/ethnic bias and discrimination in the Nebraska justice system and make recommendations to the Supreme Court on how to address any identified inequities. The major recommendation of the Final Report was to establish a standing committee to implement the Task Force's recommendations. The Minority and Justice Implementation Committee, consisting of a racially and ethnically diverse group of judges, lawyers and community leaders, has been formed and is currently working on a number of initiatives. In an effort to share their progress and future agenda the Minority and Justice Implementation Committee is proud to release its 2004 Progress Report.

PROPOSED NEBRASKA RULES OF PROFESSIONAL CONDUCT

NOTICE OF COMMENT PERIOD

On February 17, 2004, the Nebraska State Bar Association filed a "Petition to Adopt Rules of Professional Conduct Governing Attorneys," case No. S-36-040001, in which the NSBA requests that the Nebraska Supreme Court adopt the proposed Nebraska Rules of Professional Conduct and repeal Nebraska's Code of Professional Responsibility. These proposed rules are modeled after the ABA Model Rules of Professional Conduct, although certain deletions or additions to the ABA Model Rules have been proposed by the NSBA Ethics Subcommittee. Those proposed rules were thereafter adopted by the full NSBA Ethics Committee, Executive Council, and House of Delegates prior to the filing of the petition with this Court.

The Nebraska Supreme Court invites interested persons to comment on the proposed Nebraska Rules of Professional Conduct. Anyone desiring to comment on these proposed rules should do so in writing to the office of the Clerk of the Supreme Court and Court of Appeals, P.O. Box 98910, Lincoln, NE 68509-8910, or via e-mail to lasmussen@nsc.state.ne.us, no later than July 16, 2004.

The full text of the proposed Nebraska Rules of Professional Conduct is available at the Nebraska Supreme Court's Web site address, http://court.nol.org/rules/, or a hard copy of the proposed rules may be obtained from the NSBA by sending a request by mail to Nebraska State Bar Association, Jane Schoenike, P.O. BEST PRACTICES SEMINAR SERIES

The Nebraska State Bar Association's Mentoring Committee and Young Lawyers Section are co-sponsoring the Best Practices Seminar Series. Lawyers who were recently admitted to practice are invited, free of charge, to attend the series. Each session is focused on a wide range of substantive topics and offeres practical training for new lawyers. The series also identifies available resources to aid in the practice.

The series will feature two half-day seminars and one full day seminar. The half-day seminars will be held in Kearney on April 21 and May 17, 2004 at the Kearney Holiday Inn. PRACTICE TIP: CONFIDENTIALITY

Practice management advisors from bar associations and law societies (in Canada) make numerous visits to law practices to help lawyers in the management of their practices. One issue that frequently arises is the confidentiality of client information. If you are in an office sharing arrangement, you should take overt steps to ensure that persons not associated with your practice do not have access to your files or other client information. Client files must remain confidential, and that confidentiality does not extend to other lawyers or non-lawyers sharing your suite. Lock your office door when you're out of the office. Remember to do the same with the files on your secretary's workstation or in file cabinets in a public area. Also, if you share a receptionist, be sure to periodically remind him or her not to discuss your business or your clients with others sharing the suite.

PRACTICE TIP: WAYS TO KEEP IN TOUCH

Have you ever been unable to get to your office in a snowstorm or other emergency? How can you contact your clients, opposing counsel or the court to postpone important events? Keep a list of all office and home phone numbers of clients and opposing counsel. Bring home an updated hard copy of the list--or e-mail it to yourself--every few months. In case of an emergency, such as sickness, injury, storm or damage to your office--and it happens way more than we think--you will have a way to contact clients and other attorneys to inform them of the situation. Be sure to keep your client list in a confidential and secure location.
